I hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against Avature, and its officers, directors, employees, agents, affiliates, shareholders, members, successors, invitees, and assigns (collectively, "Releasees"), arising out of or attributable to my participation in the Activity, whether arising out of the negligence of Avature or any Releasees or otherwise. I covenant not to make or bring any such claim against Avature or any other Releasee, and release and discharge Avature and all other Releasees from liability under such claims. Furthermore, I acknowledge that Avature shall not be responsible for any loss or damage as a result of a substitution, alteration or cancellation/postponement of the Activity. Avature shall assume no liability whatsoever in the event this Activity is cancelled, rescheduled or postponed due to a fortuitous event.
